The discovery of classified files in President Biden’s possession is very different from Donald Trump’s case. In Trump’s case, the president was accused of improperly handling classified information by sharing it with individuals who were not authorized to access it. 

In Biden’s case, he was found to have inadvertently taken possession of the files during his transition period, and has since turned them over to the appropriate authorities. Biden has not been accused of any wrongdoing in this matter.

What is Donald Trump’s classified files case?  

Donald Trump’s classified files case is a case that was filed in 2019, alleging that the President of the United States violated the Constitution by not disclosing his financial ties with foreign governments and entities. The plaintiffs in the case are seeking access to President Trump’s financial records, which are currently protected by executive privilege. The case is currently pending in the U.S. District Court for the District of Columbia.

The president denied the allegations, claiming that he did not share any classified information. The FBI then conducted an investigation into the matter, but ultimately found insufficient evidence to bring any charges against the president.

Donald Trump’s classified files case has been ongoing since 2017, when the Department of Justice released a report that found that the FBI had sufficient evidence to investigate whether Trump and his campaign had colluded with Russia to influence the 2016 U.S. presidential election. Since then, the case has seen multiple developments.   

In May 2018, special counsel Robert Mueller was appointed to investigate the matter. He conducted an exhaustive two-year investigation, which resulted in the indictments of multiple individuals, including Trump’s former National Security Advisor Michael Flynn, Trump’s former campaign manager Paul Manafort, and Trump’s former personal attorney Michael Cohen.   

In April 2019, Mueller’s report was released to the public, and it concluded that there was not sufficient evidence to establish that Trump had conspired or coordinated with Russia to influence the election. However, it did not exonerate him on obstruction of justice.

Since then, the case has largely been in the hands of Attorney General William Barr, who has been tasked with reviewing the evidence and determining whether additional legal action should be taken. In July 2020, the Justice Department announced that it would not pursue additional charges against Trump.   

In January 2021, the Justice Department released a memo outlining its decision to close the investigation and not pursue any further legal action. The memo noted that the evidence did not establish that Trump was guilty of any criminal conduct. The decision has been widely criticized by Democrats and other opponents of the president.

In Biden’s case, he was found to have inadvertently taken possession of the files during his transition period. The transition process requires incoming administrations to review prior administration documents. Biden’s staff believed the files were in the transition process and were not aware that they had been illegally obtained. Once the mistake was discovered, the files were returned to their rightful owner.

A batch of classified documents discovered during the vice president’s tenure has been addressed by the attorney general, Merrick Garland. Garland has expressed his commitment to transparency, and has promised to take the necessary steps to ensure that the public has access to all of the materials in question. He has also promised to pursue any criminal wrongdoing that may have occurred in connection with the documents. Garland is also working to ensure that all relevant agencies are taking proper steps to protect and preserve the documents.
